General conditions of sale and use of our services

1. General

These General Terms and Conditions of Sale and Use (hereinafter referred to as “GTC“) apply to all your contractual relations with Pulsions Management SA (hereinafter referred to as “PMSA“). They are valid and applicable in all cases unless another written agreement between Pulsions and the user concerned provides otherwise.

These GTC specify the conditions of use and sale under which the “User” (hereinafter referred to as “you“) uses the services of PMSA. They represent a binding agreement between you and PMSA. By using PMSA’s services, you accept these GTC.

PMSA reserves the right to change, amend, supplement, or delete these terms and conditions in whole or in part at any time at its own discretion. Furthermore, you acknowledge that these conditions have been translated from French and that in case of discrepancy between this translation and the original French text, only the French version shall prevail.

2. PMSA provision, access, and operation of the service

PMSA offers the PULSIONS product online. It consists of a questionnaire, which highlights a large number of everyday situations, which you can answer; this questionnaire has the sole aim of identifying the way in which you act, making you aware of your behaviour, the contexts in which you do or do not act, the subjects that motivate you or not. Knowing your profile allows you to interact positively with others and to flourish in life. From your answers, a report will be produced describing this. You can access it using the usual computer media and must have an Internet connection. All connection costs are at your own expense.

PMSA does not guarantee the continuous operation of the system and cannot be held responsible for the unavailability, interruption or malfunctioning of the service for any reason whatsoever and in particular in the event of Internet access failure, third party intrusion or any other cause. PMSA cannot be held responsible for any inconvenience or damage inherent in the use of Internet services such as the presence of computer viruses or malicious software.

3. Registration for the service

PULSIONS requires that you register on the site by filling in the form provided for this purpose. This registration can be made by any physical person. You must provide all the necessary information. An incomplete registration will not be validated.

Registration automatically leads to the opening of an account in your name giving you access to a personal space which allows you to manage your use of the service.

You guarantee that the information you provide in the registration form is accurate, up-to-date, and sincere. You undertake to update your information in your personal space in the event of a change.

You are solely responsible for maintaining the confidentiality of your personal space, password and/or login.

You can access your personal space at any time after logging in.

You agree to use the PMSA services personally and not to allow any third party to use them for you or on your behalf.

4. De-registration / closing of the account

You can unsubscribe from the site and delete your profile at any time, directly from your personal space. The unsubscription is effective immediately and leads to the automatic deletion of your account.

If you have not logged in or used your account for a period of 5 years, PMSA reserves the right to close the account. You will be notified of this closure by an e-mail sent to the e-mail address provided.

In the event of a breach of these Terms and Conditions, PMSA reserves the right, without compensation of any kind, to close your account after a 10-day notice requesting you to comply with the Terms and Conditions has been sent to you in vain.

Closing the account deletes all your data and you will no longer be able to access it.

5. Financial conditions

PMSA’s services are provided to you against payment in accordance with the terms and conditions set out on the www.pulsions.com website.

Prices are in Swiss francs (CHF) and in Euro (EUR). They include all taxes.

Services must be paid for in advance using the online payment system offered by PMSA. PMSA accepts no responsibility for the use of the online payment services.

6. Intellectual property

The use of PMSA’s services does not imply any transfer to you of intellectual property rights on the elements belonging to PMSA. PMSA remains the exclusive owner of all intellectual property rights relating to the services and in particular the questionnaire. You shall refrain from any action that may directly or indirectly infringe PMSA’s intellectual property rights. You may not use, print, or reformat the content of the questionnaire and the PULSIONS report for any purpose other than private. You agree not to download, reproduce, transmit, sell, distribute, or exploit the contents of the PULSIONS questionnaire and report, or the PMSA services. You acknowledge that the information and databases accessible online are the exclusive property of PMSA.

PMSA’s services are limited to the provision of the services described on its website. Under no circumstances shall the information provided by the PULSIONS questionnaire and report constitute a recommendation or an attack on the personality, whatever the use made of the questionnaire and/or report. PMSA cannot be held responsible for the use that may be made of the information contained in the questionnaire and the report, nor for any consequences that may arise from their use. You remain solely responsible for the use of the information made available to you by PMSA.

7. Responsibility

In any case, PMSA cannot guarantee the information provided by the PULSIONS report, as it is based on information provided by you.

PMSA accepts no liability for any interruptions or defects on the website. In the event of a breach of contract, PMSA is not liable for damages caused by slight negligence. In any case, its liability is limited to a maximum amount corresponding to the price paid by you for the services of PMSA. In all cases and to the extent permitted by law, PMSA is not liable for consequential damage, lost profits, loss of data, damage resulting from downloads, or any other damage caused by the unlawful use of its services. PMSA shall also not be liable if the provision of its services is temporarily interrupted, completely or partially restricted or impossible due to force majeure. In particular, power failures, network failures or the introduction of harmful software and/or viruses shall be considered as force majeure.

8. Personal data

PMSA has a privacy policy which is set out in its data protection policy notice accessible here.

9. General provisions

PMSA reserves the right to change these terms and conditions at any time. You are invited to check the website regularly for any changes.

The fact that PMSA does not make use of any of the provisions of the GTC at a given time does not imply that it waives the right to make use of them at a later date.

In the event that any provision of the GTC is declared invalid or unenforceable by a court of law or for any other reason, all other provisions of the GTC shall remain in full force and effect.

10. Place of jurisdiction and applicable law

The contract is subject exclusively to Swiss law. The place of jurisdiction for any action against PMSA is Geneva.
